LISTACA PAYMENT, CANCELLATION AND REFUND POLICY

1. Scope
This Policy governs payments made to Listaca for digital services, including real estate listing publications, general advertising or banners, and other promotional services that Listaca may expressly offer.
It does not govern payments for rentals, deposits, reservation payments, guarantees, or stays entered into between users and third parties.
2. Provider
The service is provided by Listaca.

3. Prices
This Policy does not establish fixed prices.
Listaca may change at any time and without individual prior notice the rates applicable to future purchases.
Before confirming each payment, the user must be able to know the total amount applicable to that transaction, including items that must legally be disclosed.
The price, term, and conditions accepted in a transaction already completed will be honored and will not be retroactively replaced by a later rate.
4. What is being purchased
Real estate publication
The user purchases a digital service for publication and distribution of a listing during the period disclosed before payment.
The payment does not purchase a reservation, rental, deposit, guarantee, insurance, guests, occupancy, or specific income.
Banner
The user purchases a digital advertising distribution service during the period and under the conditions disclosed before payment.
Payment for the banner does not guarantee a specific number of clicks, visits, sales, customers, contacts, conversions, positioning, exclusivity, or specific economic results, unless any such element is expressly offered in writing in the specific purchase.
5. Banner review
Approval of payment does not constitute final approval of advertising content.
Listaca may review the banner's name, phrase, link, or destination and may approve it, request a correction, require proof of permits or rights, or reject it where there is a reason related to legality, security, or breach of the Terms.
Advertising for regulated products or services may require additional verification before activation.
6. Content that cannot be published
Listaca is not required to distribute unlawful, misleading, fraudulent, malicious content or content whose advertising does not comply with applicable provisions.
If the content can be remedied, Listaca may allow a correction.
If, before activation, it is definitively determined that the service cannot be provided and the user did not engage in fraud or a serious breach, the refund legally applicable will be processed.
7. Start of service
Where technically possible, the user requests that the digital service may begin after payment is confirmed and the applicable approval conditions are satisfied.
The activation date recorded by Listaca will determine the beginning of the period where applicable.
Immediate commencement does not imply waiver of non-waivable consumer rights.
8. Payment processor
Payments may be processed through Mercado Pago or another provider disclosed to the user.
Listaca does not intend to store full card numbers, CVV, PINs, or banking passwords.
Transaction approval may depend on the processor, issuing bank, or payment network.
9. Authorization of the payment method
By paying, the user declares that they are authorized to use the selected payment method and that the information provided is truthful.
Listaca may review or reject transactions where there are reasonable indications of an unauthorized payment method, inconsistent identity, coupon abuse, manipulation, fraud, or security risk.
10. Coupons and promotions
Coupons may be subject to validity periods, usage limits, eligible services, incompatibilities, and other conditions disclosed to the user.
Coupons obtained or used through fraud, automation, fictitious accounts, or abuse may be invalidated.
11. Term and expiration
The applicable period will be the one disclosed and accepted in the specific purchase.
At its conclusion, the service may stop being displayed automatically.
Ordinary expiration does not create a right to a refund for the portion of the period already enjoyed.
12. Renewal
Listaca does not make automatic recurring charges. Services do not renew on their own.
If recurring charges were offered in the future, before purchase Listaca would clearly, prominently, and accessibly disclose that fact, the frequency, the amount, and the charge date; obtain express consent; give at least five calendar days' notice if there were automatic renewal, with cancellation without penalty; and provide a mechanism for immediate cancellation.
13. Cancellation or removal requested by the user
The user may request that a real estate listing or banner stop being displayed before it expires.
Voluntary removal does not automatically create a right to a refund.
Any refund will be determined in accordance with this Policy and the non-waivable rights recognized by law.
14. Refunds
A full or partial refund may apply where legally required or where there is a duplicated charge, an amount different from the authorized amount is charged, Listaca is substantially unable to provide the service for a reason attributable to Listaca, Listaca definitively rejects before activation content submitted in good faith that cannot reasonably be remedied, or Listaca expressly approves a refund as resolution of a complaint.
Once the digital service has been provided, there is no automatic contractual right to recover the amount paid merely because of a change of mind, without prejudice to applicable legal rights.
15. Suspension for breach
When a service is suspended because of fraud, impersonation, unlawful advertising, malicious content, infringement of third-party rights, absence of permits the Advertiser was required to obtain, or serious breach of the Terms, Listaca may deny a refund to the maximum extent permitted by law.
This rule will not deprive the consumer of non-waivable legal rights.
16. Failures attributable to Listaca
If a failure attributable to Listaca substantially prevents distribution during a material portion of the purchased period, Listaca may restore the service, extend its duration, replace the affected period, or provide the refund legally applicable.
17. Changes made by the Advertiser
Replacing a phrase, link, or content during a campaign may require a new review.
Listaca may reject a change that transforms previously approved advertising into unlawful, unauthorized regulated, misleading, or unsafe content.
18. External websites
Listaca is not responsible for the availability or operation of the Advertiser's website.
A failure, suspension, blocking, or error of an external website provided by the Advertiser does not by itself constitute a breach of Listaca's service.
19. Duplicate or incorrect charges
To report a duplicate charge or incorrect amount, write to info@listaca.com and, where possible, include the name, email used, date, amount, payment reference, and a description of the problem.
Do not send CVV, PINs, passwords, authentication codes, or full card numbers.
20. Unrecognized payments
If a person believes that their payment method was used without authorization, they should contact their financial institution and Listaca.
Listaca may temporarily suspend the related service and preserve the necessary evidence while the matter is investigated.
21. Chargebacks
The user retains the right to dispute a truly unauthorized, duplicated, or incorrect charge.
Deliberately submitting a false chargeback regarding an authorized and provided service may constitute a breach and, depending on the circumstances, fraud.
Listaca may provide the payment processor with relevant evidence of the purchase and provision of the service in accordance with the Privacy Notice.
22. Method of refund
Where applicable, Listaca will seek to issue the refund to the same payment method originally used, unless the law permits another method.
The time for a refund to appear may depend on the processor, bank, or financial network.
23. Taxes and receipts
The total amount applicable to the transaction will be displayed before payment in accordance with the corresponding legal obligations.
Listaca will comply with the tax obligations applicable to it and will address requests for tax receipts where legally applicable.
24. Changes to rates and services
Listaca may create, withdraw, or modify plans, durations, features, and prices for future purchases without individual prior notice.
An existing purchase is governed by the conditions the user accepted when paying.
