LISTACA TERMS AND CONDITIONS OF USE AND CONTRACTING

These Terms and Conditions govern access to, use of, and contracting of the services offered through Listaca and listaca.com.
1. Provider identity
The service is offered under the trade name Listaca.
The channel for complaints and clarifications is info@listaca.com.
2. Scope of Listaca
Listaca mainly provides two types of digital services:
a) Real estate listing publication. Spaces intended for third parties to publish information about properties they offer for rental, lodging, or another form permitted by law.
b) General advertising or “banner”. Advertising spaces located on Listaca that may promote goods, services, businesses, establishments, professionals, events, websites, applications, or other third-party content provided that they are lawful and their advertising is legally permitted.
Listaca's general advertising is not limited to the real estate sector.
In these Terms, “Advertiser” includes both a property advertiser and a purchaser of advertising space, unless the context indicates otherwise.
3. Nature of Listaca
Listaca is a publication and distribution platform. Purchasing space on Listaca does not make Listaca the manufacturer, seller, distributor, service provider, agent, representative, partner, franchisor, broker, insurer, guarantor, or party to transactions that the Advertiser enters into with third parties.
With respect to real estate listings, Listaca is not the lessor, sublessor, owner, property manager, real estate agency, hotel operator, travel agency, depositary, trustee, surety, or party to the agreement entered into between host and guest.
With respect to banners, Listaca sells the advertising distribution service, not the advertised product or service.
The label “Advertising”, “Ad”, or another equivalent label serves to identify paid content and does not constitute a recommendation, certification, or guarantee by Listaca.
4. Acceptance and capacity
To purchase a publication or advertising service, the user declares that:
- they are at least 18 years old and have legal capacity to contract;
- they act on their own behalf or have sufficient authority to represent the corresponding rights holder;
- they will provide truthful and current information;
- they have been able to review these Terms, the Privacy Notice, and the Payment Policy before completing the purchase; and
- they accept those documents through the electronic mechanism made available to them.
Listaca may retain electronic evidence of acceptance and of the transaction in accordance with applicable law and the Privacy Notice.
5. General advertising in the banner
Listaca's lower advertising space may be used to promote a broad variety of activities, goods, services, or content provided that they are lawful and their promotion complies with applicable provisions.
The advertising Advertiser is responsible for:
- the truthfulness and verifiability of every advertising claim;
- holding rights to the trade names, trademarks, photographs, texts, promotions, and other materials used;
- having the permits, licenses, registrations, authorizations, notices, or mandatory legends when applicable;
- honoring the prices, promotions, conditions, warranties, and restrictions advertised;
- keeping the website or destination to which the banner links active and secure;
- not misleading users regarding identity, origin, characteristics, results, certifications, discounts, or availability; and
- complying with consumer-protection law and any sector-specific regulation applicable to what is advertised.
Listaca may request documentary evidence of any of the foregoing before or during publication.
6. Regulated or higher-risk advertising
Purchasing a banner does not imply automatic acceptance of every category of advertising.
Listaca may reject, suspend, or subject to prior review advertising related to sectors governed by special regulation, including health, medicines, supplements, medical devices, foods with health claims, alcohol, tobacco or nicotine, financial services, credit, investments, gambling, sweepstakes, raffles, political or electoral activities, weapons, age-restricted products, sexual services, products or services whose commercialization requires a license, and any other category whose distribution may require authorization, notice, or a specific legend.
Listaca may require the Advertiser to first prove the corresponding permits or authorizations. If Listaca reasonably considers that publication may create a regulatory violation or legal risk, it may refuse publication even if the Advertiser maintains that the content is lawful.
Nothing above releases Listaca from obligations imposed directly on it by law as a distribution medium.
7. Misleading advertising and claims
False, misleading, abusive, inaccurate advertising, or advertising that may cause error or confusion, is prohibited.
The Advertiser must be able to objectively substantiate verifiable claims used in the advertisement, particularly claims regarding price, discounts, quality, origin, composition, results, benefits, certifications, availability, promotions, awards, testimonials, endorsements, or any other material characteristic of what is advertised.
Listaca may request that a claim be removed or modified before authorizing or continuing publication.
8. Banner destination and external links
The banner may contain a link provided by the Advertiser.
The Advertiser guarantees that the destination:
- reasonably corresponds to the advertised content;
- does not contain malware, phishing, malicious downloads, or mechanisms intended to deceptively obtain credentials;
- is not deliberately changed after approval to redirect to unlawful or substantially different content;
- complies with applicable law; and
- does not impersonate Listaca or cause users to believe that Listaca endorses, certifies, or guarantees the advertised business.
Listaca may suspend a banner if its destination changes, becomes inaccessible, presents security risks, or violates these rules.
Listaca does not control or manage transactions that a user conducts after leaving Listaca and accessing the Advertiser's website.
9. Real estate listings
Anyone who publishes a property declares and guarantees that:
- they are the owner or have sufficient authorization to advertise it;
- they have the right to offer it under the published conditions;
- the information, photographs, prices, characteristics, location, availability, and contact details are truthful;
- they hold the rights or authorizations for the photographs, videos, and texts uploaded;
- they do not use images of a different property in order to mislead;
- they will keep material listing information up to date; and
- they will comply with the tax, municipal, tourism, contractual, condominium, and regulatory obligations applicable to them.
Listaca may request reasonable evidence of the legitimacy of the listing.
10. Listaca does not participate in rentals
Listaca does not receive or hold deposits, advances, rents, reservation payments, or guarantees related to a stay.
Listaca does not negotiate on behalf of the parties, deliver keys, take possession of the property, or guarantee the identity, solvency, conduct, availability, or performance of hosts or guests.
Disputes arising from a rental or stay, including deposits, cancellations, damages, refunds, property conditions, or breaches, are matters between the parties involved, except for matters legally attributable directly to Listaca.
11. Property prices and availability
Property prices and availability are provided by the Advertiser.
A property's appearance on Listaca does not by itself constitute a confirmed reservation, an irrevocable offer, or a guarantee of availability. The interested person must confirm directly with the Advertiser before paying for a stay.
Calendars may draw from manually entered information or external sources and may experience delays, synchronization failures, or incomplete information.
12. Content owned by the Advertiser
The Advertiser retains whatever rights they legally hold in their content.
By providing it to Listaca, the Advertiser grants a non-exclusive, worldwide, royalty-free license limited to what is necessary to store, host, reproduce, and display the content; adapt format, dimensions, compression, or resolution; generate thumbnails; convert files to technical formats; make backups; and reasonably display examples or screenshots of Listaca for operation or promotion of the service itself.
The license does not transfer ownership of the original content to Listaca.
13. Third-party advertising material
For the banner, the Advertiser authorizes Listaca to display the trade name, advertising phrase, and link provided for the duration of the service.
The Advertiser will be responsible for any claim arising from materials they provided without sufficient authorization, without prejudice to obligations that may legally correspond to Listaca.
14. Prohibited conduct and content
It is prohibited to use Listaca for:
- fraud, scams, phishing, extortion, or impersonation;
- goods, services, or activities whose offering or advertising is unlawful;
- content that infringes copyright, trademarks, image rights, or privacy;
- counterfeit goods or goods of unlawful origin;
- advertising that conceals material information or misleads;
- malware, malicious links, or deceptive collection of credentials;
- services or products whose advertising is prohibited by law;
- trafficking, exploitation, or criminal activities;
- collecting personal data through deception;
- spam obtained through extraction of data from Listaca;
- unauthorized scraping, crawling, or mass extraction;
- circumvention of security controls or unauthorized access;
- manipulation of coupons, payments, refunds, or chargebacks; or
- any use that reasonably exposes Listaca or its users to legal or security risk.
15. Moderation and right to reject
Listaca may review, reject, request changes to, restrict, hide, or suspend content when there is an objective reason related to legality, security, third-party rights, falsity, fraud, or breach of these Terms.
Acceptance of payment does not require Listaca to distribute unlawful or prohibited content.
When possible, Listaca may offer the Advertiser an opportunity to correct a remediable defect. In cases involving fraud, security, an authority's order, or legal risk, suspension may be immediate.
16. Reports and removal of content
A person who believes that a listing or banner uses their property, telephone number, identity, photograph, trademark, work, or another right without authorization may report it to info@listaca.com.
The report must reasonably identify the complainant, the listing or banner at issue, the right or problem alleged, and the available evidence.
Listaca may request additional information to prevent fraudulent reports and preserve records relevant to legal defense or legal requests.
17. No endorsement of third parties
The fact that Listaca publishes a paid advertisement does not mean that Listaca recommends, certifies, inspects, or guarantees the Advertiser, its business, product, service, property, or website.
Where a specific verification exists, its scope must be expressly indicated.
18. Purchased service and price
Listaca may charge for real estate listings, advertising spaces, and other digital services it offers.
Prices do not form a permanent part of these Terms. Listaca may change rates applicable to future purchases at any time and without individual prior notice.
Before confirming payment, the user must be able to know the total amount applicable to that transaction, including charges that must legally be disclosed. The price and conditions accepted in a transaction already completed must be honored.
19. Payments to Listaca
Every payment made to Listaca applies exclusively to the digital service identified during the purchase process.
For real estate listings, payment to Listaca does not constitute rent, a deposit, reservation payment, advance, or guarantee of a stay.
For banners, payment applies only to the purchased advertising distribution and does not guarantee sales, visits, clicks, customers, conversions, income, or specific results.
20. Payment fraud and chargebacks
The user must not use payment methods without authorization or deliberately submit a false unauthorized-charge claim regarding a transaction they did authorize.
Listaca may retain and provide to the payment processor or competent authority evidence of the transaction, acceptance, provision of the service, and relevant communications, in accordance with the Privacy Notice.
This clause does not limit a person's right to dispute a truly unauthorized, duplicated, or incorrect charge.
21. Listaca intellectual property
Listaca's software, design, interface, code, data structure, visual identity, logos, and proprietary content are protected by applicable law.
Use of Listaca does not grant the user a license to copy, exploit, decompile, or commercially reproduce these elements, except as permitted by law.
22. Technical availability
Listaca will seek to keep its services available, but interruptions may occur due to maintenance, external providers, connectivity, updates, attacks, technical failures, or force majeure.
If a failure attributable to Listaca substantially prevents delivery of a paid service, the Payment Policy and applicable law will apply.
23. Limitation of liability
To the maximum extent permitted by law, Listaca is not liable for contractual breaches between users and Advertisers, goods or services sold by a banner advertiser, damages arising from a stay contracted directly with a third party, false content introduced through deception without Listaca's actual knowledge, acts of third parties outside the platform, expected economic results of a campaign, or failures of external services outside Listaca's reasonable control.
This provision does not exclude liabilities or rights that legally cannot be limited.
24. Advertiser liability
Where legally applicable, the Advertiser will be liable for damages, penalties, or claims directly caused by content provided without sufficient rights, false or unsubstantiated advertising claims, failure to obtain permits the Advertiser was required to obtain, fraud, impersonation, malicious web destinations, or breach of these Terms.
This clause does not displace liabilities that a law imposes directly on Listaca.
25. Personal data
Processing of personal data is governed by the Comprehensive Privacy Notice.
In real estate listings, certain contact details chosen for contact may be made public as part of the service.
In banners, the name or trade name, advertising phrase, link, and, if the Advertiser provides one, a WhatsApp number may be made public. The email used to purchase is not ordinarily shown on the banner.
26. Operational communications
Listaca may send communications necessary regarding contracting, payment, approval, rejection, expiration, support, security, material modifications, or legal compliance.
27. Cancellation and removal
The Advertiser may request that their content stop being displayed.
Removal of content does not by itself create a right to a refund. The financial effects will be governed by the Payment Policy and applicable non-waivable rights.
28. Changes to the Terms
Listaca may update these Terms due to legal, technical, or commercial changes.
Changes will not retroactively modify the price or financial conditions of a transaction already completed, except where required by law or by a valid agreement with the user.
29. Applicable law and disputes
These Terms are governed by the laws of the United Mexican States.
The user may submit clarifications or complaints through info@listaca.com. Nothing prevents a consumer from going to PROFECO or another competent authority.
Any agreement regarding jurisdiction will be understood without prejudice to the venues and non-waivable rights available to the consumer.
